Property Access and Addressing
Any property access that involves constructing or placing a structure within Council’s road reserve requires approval through a Vehicular Access application.
Approval is required for both the location and construction of any property access. A Vehicular Access application is a form of approval under Section 138 of the Roads Act 1993 (NSW). A Section 138 application is required for any works carried out within a public road or road reserve and approval must be issued before any works commence.
Kyogle Council accepts applications for vehicular access via the NSW Planning Portal (link to portal here). Applicants must obtain approval before carrying out any works within the road reserve.
The Vehicular Access application process applies to all types of access, including (but not limited to) access for cars, trucks, buses, motorcycles, pedestrians, wheelchairs, motorised carts and bicycles and all occupied properties are required to have a legal vehicular access that meets Council’s minimum standards. This applies to both new accesses and existing accesses, regardless of whether approval was previously obtained.
All costs associated with the construction and ongoing maintenance of a property access are the responsibility of the property owner. This responsibility transfers with ownership of the land.
Council is also responsible for the allocation of property addresses within the Kyogle Local Government Area. The addressing system aligns with the Australian Standard for rural and urban addressing (AS/NZS 4819:2003). In rural areas, property addressing is managed as part of the vehicular access application process.
